1. Acceptance of Terms & Conditions
  
  
 
  1.1 These terms govern your use of the Browseajob.com's website ("the Website"). Please read the terms carefully. By entering this Website you acknowledge that you are bound by these Conditions. If you do not wish to be bound by these Conditions please exit the Website.
   
  1.2 The services offered on the Website consist of:
   (a)supplying copies of your personal details and employment history ( “CV/Resume” ) (i.e. summaries of your training, skills, employment and education compiled for the purposes of obtaining employment in the format specified by Browseajob.com) to prospective employers as and when requested by employers (the "Service") if you choose to make your profile visible;
 
 
 
2. Intellectual Property
 
  
  2.1 The copyright and all other intellectual property rights in the contents of the Website belong (or are licensed) to Browseajob.com and except as detailed in 2.2 below, the contents of the Website may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form whatsoever, or by any means.
   
  2.2 You may permit your computer to make an electronically stored, transient copy of the contents of this Website only for the purpose of viewing it while connected to the Internet. You may only make one copy of any contents and will not use such copy in any commercial manner.
   
3. Candidate's Obligations
  
   
  3.1
 
You shall provide CV/Resumes in the format specified and shall up date them as and when the information in the CV/Resume (or any of it) contained therein becomes out of date or inaccurate.
   
  3.2 You warrant that all information that you provide to us in relation to your CV/Resume or otherwise:
    
  (a)is true and accurate;
   
  (b)is not offensive, discriminatory, obscene, defamatory or in any other way illegal; and
   
   (c)does not infringe any rights of any third party (including without limitation the copyright of any such third party).
    
  3.3 You will indemnify us for any losses or liabilities we may suffer or incur due to the content of any information you provide to us.
    
4. Information Requests
   
    
  4.1 You shall use all reasonable endeavours to respond promptly to any requests for guidance, instruction or information and any other form of assistance reasonably required by Browseajob.com to enable it to perform the Service.
    
5. Limitation of Liability
   
    
  The service is free of charge and therefore:
    
  5.1 we do not limit our liability for personal injury or death caused by negligence;
    
  5.2 we shall not be liable for:
    
   (a) any losses you may make which result from your use (or inability to use) the Website (including any damage to your hardware or software due to any viruses or cookies);
    
   (b) inaccuracy of any job details, the unavailability of the job in question or the activities or conduct of any potential employer or party who places an advertisement on the Website;
    
   (c) any lost data and, accordingly, you should keep a separate record of any details you enter into the Website;
    
   (d)interruptions or restrictions in access to the Website or any delay, costs, damage or other loss (including without limitation loss of profits) howsoever caused arising from any matter beyond the reasonable control of Browseajob.com.
    
  5.3 The Website may contain technical inaccuracies and/or typographical errors. We accept no responsibility as to the accuracy, completeness, suitability or fitness for purpose of any material on, or the reliability of access to this Website or for keeping material up-to-date or any liability resulting from its failure to do so.
    
  5.4 We reserve the right, at our discretion, to amend or delete any information you have entered into the Website.
    
  5.5 In carrying out the Service or providing the Additional Services Browseajob.com may use information provided to it by you and/or third parties (including prospective employers). Browseajob.com will use all reasonable endeavours to ensure the reliability of any third party sources but Browseajob.com accepts no liability for the accuracy of the information (in particular the information set out in advertisements or vacancies) which prospective employers provide.
    
  5.6 Browseajob.com makes no warranty or representation that it has verified any of the material on this Website or has vetted any prospective employer.
    
  5.7 Subject to condition 5.4, all advice and information supplied by Browseajob.com under the Service will be supplied in good faith but Browseajob.com gives no guarantee as to any advice or information it supplies nor that following submission of your CV/Resume to any prospective employer, that you will be interviewed or employed or you will receive a response, or that you will be suitable to meet the requirements of that employer.
    
  5.8 Nothing herein shall impose any liability upon Browseajob.com in respect of any defect in the Service or Additional Services arising out of the acts, omissions, negligence or default of you or a prospective employer including in particular (but without prejudice to the generality of the foregoing) any failure by you to comply with any recommendations of Browseajob.com and any errors, omissions inaccuracies or other defects in any CV/Resumes provided by you.
    
  5.9 You shall indemnify Browseajob.com in respect of any costs, claims, demands or expenses incurred by Browseajob.com and for which it may be liable to any 3rd party including (but without limitation) infringement of any 3rd party rights (such as intellectual property rights) due to or arising from your acts, omissions or defaults or the submission by you of any inaccurate misleading unlawful or defamatory statement in a CV/Resume.
    
6. Cancellation
   
    
  6.1 Browseajob.com reserves the right at any time to remove a CV/Resume from the Browseajob.com site in the event that Browseajob.com considers that the CV/Resume breaches any applicable laws or the rights of any third party or is prejudicial to the interests of Browseajob.com.
    
7. General
   
    
  7.1 No waiver by either of us of any of these requirements or of any of our rights hereunder shall release the other from full performance of the remaining obligations.
   
  7.2 Nothing herein shall be deemed to constitute, evidence or compromise a partnership between us nor to constitute either of us the agent of the other.
   
  7.3 Should any provision of these Conditions be void or voidable the existence or avoidance thereof shall not prejudice the enforceability of the remaining provisions hereof.
   
  7.4 Our agreement in relation to the Services and the Additional Services, incorporating these Conditions, shall be governed by and construed in accordance with English law and you hereto agree to submit to the non-exclusive jurisdiction of the English Courts.
    
   7.5A person who is not a party to the agreement between Browseajob.com and the Candidate has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of there Conditions but this does not affect any right or remedy of a third party which exists or is available apart from that Act.

  These terms govern your use of Browseajob.com's website ("the Website") and our relationship with you. Please read the terms carefully. By entering this Website or supplying an advertisement to us for display on the Website you acknowledge that you are bound by these terms.
  
 

II.

Obligations of the Recruiter
 
  
  A. You undertake to comply with the provisions of and ensure that your actions do not put us in breach of the Data Protection Act 1984 and/or 1998 or relevant legislation with regard to any applicant information received by you and in particular to keep such information confidential and to use such information solely for the purposes of recruitment in connection with the relevant advertisements placed by you and in response to which the information was provided and not to pass such information to any third parties without the applicant's consent.
  
  B. You are responsible for ensuring that the content of any advertisement:
   
   1. is true and accurate;

2. complies with all relevant legislation and any applicable codes of practice in all applicable jurisdictions;

3.
is not discriminatory, obscene, defamatory, or in any other way illegal and does not infringe the rights of any third party (including without limitation the intellectual property rights of any third party).
 
  
  C. You are also responsible for satisfying yourself as to the suitability and availability of any candidate whose CV/Resume is provided to you through the Website.

D. To pay any fees due in accordance with clause III below.
 
  
III. Advertisements and Payment Provisions
 
 
1.
Each vacancy advertised by you (an "Advertisement") shall consist of no more than 500 words.

2.
For each Advertisement you will be charged a fee on the following basis:
   
   The site uses a credits system where the price for each credit excludes VAT. Both Recruitment Agencies and Employers are charged the same price to advertise on the Website. The Display Period for advertisement is dependent up on the job advert package that was purchased. 
  
  3. If the vacancy to which an Advertisement relates is filled during the course of the Display Period which you have paid, you will be not entitled to use your Advertisement to display another single vacancy for the remainder of that Display Period.

4.
Payment for the first Display Period is due upon order by credits purchased via a credit card or in such other manner agreed, payment must be received before the  commencement of such Display Period.

5.
All credits purchased on this site in order to be used to pay for an Advertisement will be valid for 12 calendar months.

6.
If payment for a Display Period is not received in accordance with clause III 3 or 4 as applicable. above then, in addition and without prejudice to our rights in clause IV, we reserve the right to remove such Advertisement.
  
IV. Right to Remove
 
 

We reserve the right to, at any time, remove your advertisements and/or any information supplied by you from the Website at our discretion or to change the size or position of the same and/or to terminate the provision of services to you forthwith and thereby terminate any responsibility we may have toward you under the these terms and conditions or otherwise.
  
V. Intellectual Property
 
 
Unless otherwise indicated please note that all copyright and any other intellectual property in the Website, its contents and "look and feel" belong or are licensed to Browseajob.com.
  
VI. Liability
 
 
Notwithstanding any other provisions in these terms, we do not limit our liability for personal injury or death caused by our negligence, however please note the following:
   
   1. We shall not be liable for any losses you may make which result from your use (or inability to use) the Website including but not limited to damage to your hardware or software due to any viruses or cookies transmitted therefrom or otherwise, loss of copy, artwork or other data, Advertisements or other materials which you supply to the Website;

2.
In providing the services offered on the Website Browseajob.com may use information provided to it by you and/or third parties (including prospective employees). Browseajob.com will use all reasonable endeavours to ensure the reliability of any third party sources but Browseajob.com accepts no liability for the accuracy of the information (including but not limited to the information set out in applicant's CV/Resumes) provided to it;

3.
Browseajob.com makes no warranty or representation that it has verified any of the material on this Website or has vetted any applicant;

4.
You acknowledge that you are responsible for the conduct of all interviews with applicants, taking up references, work permits etc and that we are not responsible for the performance or conduct of any applicant.
  
VII. Indemnity
 
 
You agree to indemnify us and to keep us indemnified in respect of all damages, costs, liabilities, expenses or damages that we may incur arising from your use of the Website and/or content of your advertisement(s), including but not limited to:
  
1.
the publication of any defamatory or obscene statement;

2.
breach of copyright or any other third party intellectual property right;

3.
any claims made by any person in respect of race, religion, age, sex or disability discrimination.
  
VIII. Third Party Rights
  
   1. Contracting Party

Governing law and jurisdiction
Use of the Website and these terms shall be governed by, and construed in accordance with, the laws of England and Wales and each party irrevocably submits to the exclusive jurisdiction of the English courts.
